Acknowledgement of Risk, Release and Consent
In consideration of being permitted to participate and/or volunteer in the BLUE RIBBON RALLY CAR SHOW FOR PROSTATE CANCER AWARENESS (“the BRR”) by the individuals and entities identified as “Sponsors and Operators” below, and other consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned agrees as follows:
Sponsors and Operators. Idaho 2 Fly, Inc., Idaho Urologic Institute/Surgery Center of Idaho (IUI/SCI), Boise Idaho Jeep Club, Idaho British Car Club, and others lending financial or in kind support, hereinafter referred to collectively as “the Sponsors and Operators” are the sponsors and operators of the BRR and the object of this Acknowledgement of Risk, Release and Consent.
Acknowledgement of Risk. Although the Sponsors and Operators, their officers, directors, agents, spouses, legal representatives, volunteers, designees, and the owners and operators of the property on which the BRR is taking place (referred to hereinafter collectively as the “BRR Team”) have taken reasonable steps to organize the BRR so I can enjoy activities for which I may not be skilled in locations with which I may not be familiar, I understand that the activities of the BRR are not without risk. In particular, I understand that many risks are inherent in outdoor activities and the operation of motor vehicles, and that those risks cannot be eliminated without destroying the unique character of the activities of the BRR. I further understand that these risks can include the loss or damage of property and injury, illness or death and agree that I have assessed my skill and ability to participate in the BRR and voluntarily decided to participate. I also understand and agree that I have a responsibility to act reasonably to protect myself from these risks, including specifically risks associated with the BRR.
Release. I assume and accept full responsibility for myself and my property. I also hereby release and discharge the BRR Team and their successors from and against any and all loss, damage, claims, demands, costs, expenses and liability, of any kind, for personal injury, death and/or property loss arising out of or associated with the BRR, without regard to whether any of the foregoing are caused by the negligence of the BRR Team or otherwise.
Consent. I consent and grant permission to the BRR Team to use, reproduce, distribute and publically display audio recordings and video, film and photographic images and footage of me and/or my likeness, with or without my name, that are created in connection with the BRR. I also release and discharge the BRR Team and its successors from and against any all liability, loss, claims, suits, damages, costs or expenses for defamation, libel, invasion of privacy, publicity or personality, infringement of copyright or any similar matter based upon or otherwise related to the use and exploitation of the audio and/or images described above and/or the rights granted hereunder.
I affirm that I am over the age of 18, that I have the right to contract on behalf of myself, and, if I operate a motor vehicle in the BRR, that I have current, applicable motor vehicle insurance and am licensed to operate any motor vehicle I operate in the BRR.
I have read this Acknowledgement of Risk, Release and Consent prior to my execution of the same, and I fully understand its contents. This Acknowledgement of Risk, Release and Consent shall be binding upon me, together with my respective heirs, legal representatives and assigns.
